Terms of Service

1. Acceptance of These Terms

These Terms of Service (Terms) govern your access to and use of tattooideas.app and the TattooIdeas design, lettering, image-conversion, and virtual try-on tools (the Service). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of legal majority where you live, and legally able to enter into these Terms.

2. What TattooIdeas Provides

TattooIdeas helps users explore tattoo concepts using AI-generated artwork, image conversion, lettering previews, and virtual placement tools. Outputs are creative references. They are not final tattoo instructions, medical advice, or a substitute for review by a qualified tattoo artist.

AI model and access-provider disclosure: TattooIdeas currently uses the following models for its AI image features:

• AI Tattoo Generator: openai/gpt-image-2, accessed through Replicate.
• Image to Tattoo Converter: openai/gpt-image-2, accessed through Replicate.
• AI Tattoo Stencil Generator: openai/gpt-image-2, accessed through Replicate.
• AI Tattoo Cover-Up Generator: uses openai/gpt-image-2/edit, accessed through fal.ai, to produce the inpainted cover-up preview.

Prompts and images submitted to these features are sent to the stated access provider for the requested processing. This disclosure does not mean that Replicate, fal.ai, or any model provider endorses a particular output.

Features may change as we improve the Service. We may add, remove, limit, or discontinue a feature when reasonably necessary, including for security, legal, provider, or operational reasons.

3. Accounts

The public Service currently uses Google sign-in. You are responsible for maintaining the security of your Google account and for activity performed through your TattooIdeas account. You must provide accurate information and promptly notify support@tattooideas.app if you suspect unauthorized access.

You may not sell, transfer, share, or create accounts through automated or deceptive means. We may suspend access when reasonably necessary to investigate abuse, fraud, security risks, chargebacks, or violations of these Terms.

4. Credits, Generations, and Payments

AI generation uses credits. Current package prices, included credits, and generation costs are shown on the Pricing page and in the creation interface before a charge. TattooIdeas may change prices or credit costs prospectively; changes do not reduce credits already in your account.

• Welcome credits are a one-time promotional grant and have no cash value.
• Purchased credits are personal, non-transferable, and cannot be resold or exchanged for cash.
• Purchased credits currently do not expire, unless required by law or clearly disclosed before a future purchase.
• A generation charge is recorded when an AI request is accepted for processing.
• If our system records that a generation failed before producing a usable result, the related generation credits are returned automatically. This credit reversal is not a cash refund.

Payments are handled by the provider identified on the current checkout page; depending on the deployment, this may be Waffo Pancake, PayPal, or Stripe. Waffo acts as merchant of record and authorized reseller for a Waffo Pancake checkout. Stripe may act as merchant of record when its Managed Payments checkout is displayed; otherwise Stripe or PayPal processes the payment in the role shown at checkout. By completing checkout, you authorize the displayed provider to charge the displayed package price plus any tax shown before confirmation. The provider's applicable buyer, payment, and privacy terms may also apply. If a purchase is duplicated, unauthorized, not delivered, or materially incorrect, contact us promptly and, where appropriate, follow the provider's support or dispute process. Eligibility for a monetary refund depends on the circumstances, the provider's procedures, and applicable law. Nothing in these Terms limits mandatory consumer rights.

5. Your Content

You retain the rights you have in prompts, images, artwork, and other materials you submit (User Content). You grant TattooIdeas a limited, worldwide, non-exclusive license to host, copy, transmit, process, modify, and display User Content only as reasonably necessary to operate, secure, troubleshoot, and provide the Service you request.

You represent that you have the rights and permissions necessary to submit User Content and to instruct us and our providers to process it. Do not upload confidential material or images of another person without appropriate permission.

6. AI-Generated Output

Subject to applicable law and third-party provider terms, you may use output generated for you for personal or commercial tattoo-design projects. AI output may be similar or identical to output created for other users, may contain errors, and may not qualify for copyright or other intellectual-property protection in every jurisdiction. TattooIdeas does not guarantee exclusivity, originality, registrability, or non-infringement.

You are responsible for reviewing output before using it. In particular, ask a qualified tattoo artist to check line weight, anatomy, scale, placement, cultural meaning, and whether a design can be tattooed safely and legibly.

7. Tattoo and Health Disclaimer

TattooIdeas does not provide tattooing, medical, dermatological, or professional health services. Virtual try-on images are visual simulations and may not accurately represent skin tone, body curvature, healing, aging, pain, allergies, scarring, infection risk, or the final result on your body.

Before receiving a tattoo, consult an appropriately licensed and experienced tattoo professional. Seek medical advice if you have concerns about skin conditions, allergies, medications, pregnancy, healing, or other health risks.

8. AI Acceptable Use and Content Safety

This section applies to prompts, uploaded images, editing instructions, generated results, attempts to generate content, and any later use or distribution of a result. You may not use the Service to request, upload, generate, keep, share, or facilitate:

• Sexual, NSFW, or nudity content, including pornography; sexually explicit or suggestive imagery; exposed intimate body parts; fetish content; sexual services; non-consensual intimate imagery; or sexualized depictions of any real, fictional, or AI-generated person.
• Violent, graphic, or gore content, including depictions that glorify, encourage, or instruct violence; blood or open wounds; bodily destruction, dismemberment, mutilation, torture, extreme suffering, animal abuse, terrorism, or violent extremism.
• Hate speech or hateful content, including material that attacks, threatens, dehumanizes, or promotes discrimination or violence against a person or group based on a protected characteristic.
• Child sexual abuse material (CSAM) or other unsafe content involving minors, including any real, synthetic, or fictional material that exploits, endangers, grooms, sexualizes, abuses, or graphically depicts violence toward a person under 18.
• Deepfakes or impersonation of a real person, including deceptive or non-consensual use of another person's face, body, voice, private information, or likeness without the rights and consent required by law.
• Copyright or trademark infringement, including copying protected characters, logos, artwork, or other material when you lack the rights, license, permission, or applicable legal exception required for that use.
• Suicide, self-harm, or disordered-eating promotion, encouragement, instructions, or graphic depiction.
• Threats, harassment, stalking, bullying, or targeted abuse.
• Illegal activity, weapons development or use, trafficking, exploitation, fraud, phishing, malware, or instructions that meaningfully facilitate wrongdoing.
• Content that otherwise infringes privacy, publicity, or other rights; confidential material you are not authorized to provide; or false claims that an AI result is guaranteed original, medically safe, or approved by a tattoo professional.
• Attempts to bypass safety controls, authentication, credits, payment controls, rate limits, or other technical restrictions; unauthorized scraping, reverse engineering, resale, or automated access.

Safety checks and review

Before the AI Tattoo Generator produces an image, the user prompt is screened by Waffo Pancake's Prompt Screening API using automated rule and semantic review. Generation proceeds only when that screening returns an allow decision. The Replicate-hosted openai/gpt-image-2 request also uses the model's automatic moderation setting, whose safety controls may reject a request before returning an image. Automated controls can make mistakes and do not transfer responsibility for your content or use of a result to TattooIdeas.

After generation, TattooIdeas does not run a real-time automated scan of every output. An output flagged by safety controls or reported by a user enters manual content-safety risk review. Authorized personnel may review the relevant prompt, input, result, and account context only as reasonably necessary to decide and address the safety issue.

User-generated results remain private to the user's account and are not published by TattooIdeas to a public gallery or feed. This does not prevent a user from independently downloading or sharing a result, subject to these Terms and applicable law.

Depending on severity, context, and repeat behavior, we may refuse or stop a generation, withhold or remove a result, restrict access, warn the user, suspend or terminate an account, preserve information, or report conduct when required by law. Credit reversals for failed generations remain governed by Section 4; a safety review or enforcement action does not by itself promise a monetary refund.

Reporting content-safety concerns

Report suspected violations to support@tattooideas.app or through our contact page. Include the relevant project or generation identifier and a concise explanation; do not resend unlawful material unless we specifically request information needed to investigate it. We will provide an initial acknowledgment or substantive response within two business days after receiving the report. Investigation and final resolution may take longer depending on the report's complexity, evidence, and legal obligations.

9. TattooIdeas Intellectual Property

The Service, including its software, interface, branding, templates, copy, and original assets, is owned by or licensed to TattooIdeas. These Terms do not transfer ownership of the Service to you. You may not use our trademarks or copy substantial parts of the Service without permission.

10. Third-Party Services

The Service relies on third parties such as Google; Cloudflare; Replicate, which provides access to openai/gpt-image-2 for the features described in Section 2; fal.ai, which provides access to openai/gpt-image-2/edit for cover-up preview generation; and the payment provider displayed at checkout, which may be Waffo Pancake, PayPal, or Stripe. Their availability, safety controls, and terms may affect the Service. TattooIdeas is not responsible for third-party services outside our reasonable control.

11. Availability and Disclaimers

The Service is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee that a generated design will meet your expectations, be unique, be suitable for tattooing, or remain available indefinitely.

12. Limitation of Liability

To the maximum extent permitted by law, TattooIdeas will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from the Service. Our total liability for claims relating to the Service will not exceed the amount you paid to TattooIdeas during the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Mandatory consumer rights remain unaffected.

13. Suspension and Termination

You may stop using the Service or delete your account. We may suspend or terminate access for a material violation of these Terms, fraud, security risk, legal requirement, or conduct that harms the Service or others. Where practical, we will provide notice and an opportunity to address the issue.

Sections that by their nature should survive termination—including payment obligations, intellectual property, disclaimers, and liability limitations—will continue to apply.

14. Changes and Disputes

We may update these Terms to reflect changes to the Service or law. We will post an updated effective date and provide additional notice when required. Continued use after revised Terms take effect constitutes acceptance where permitted by law.

Before starting a formal dispute, please contact us and allow a reasonable opportunity to resolve the issue. These Terms do not prevent you from using consumer-protection remedies or courts available under applicable law.
